PUBLIC HEARINGS AND APPOINTMENTS
REQUEST FOR A DETERMINATION OF APPLICABILITY (RDA); NOTICE OF INTENT (NOI), ABBREVIATED NOTICE OF RESOURCE AREA DELINEATION (ANRAD), ORDER OF CONDITIONS (OOC)

Present: Chair Brian Berube, Lori Stephenson, Jeff Bryan, Jeff Larence (phone-in), and Conservation Agent Rebecca Longvall
7:10pm Chair Brian called to order the public meeting. Chair Brian opens the first public hearing for the Duhame property and shed placement. The applicant has requested a continuance. Brian makes a motion to continue the public hearing until August 1st at a time to be determined. Jeff B second, all unanimously approve.
Other agenda items are addressed including the consideration of a shed for Tom Denney camp by the water for storage of paddles and life jackets. The commission requested further information regarding placement, length of time it will be in place, etc.
Century Mill routine site visits were recollected and removal of sedimentation via small excavator with rubber tracks and ply-board use was granted to allow effective and efficient work in restoring any disturbed area. Lori addressed the need to make stock piling of sediment controls mandatory on larger projects to reduce potential sedimentation after storms.
Chair Brian makes a motion to approve minutes for 6/9/2017 as drafted. Jeff B second, all unanimously approve.
7:30pm Andre and Marta Costa submitted a request for Certificate of Compliance on restoration project. Rebecca addressed the commission with the reports completed post planting by predecessors along with the release of the total escrow funds proving the completion and compliance with the Order of Conditions along with a site visit herself. Chair Brian makes a motion to issue COC. Jeff B Seconds, all unanimously approve.
7:40pm The property located at 23 Harris Farm Road has been released from Chapter 61A as a practice of the right-of-first-refusal the town asks if departments are interested in the acquisition of the property. There is no level of interest other than potential trail easements or conservation restriction on the property through conversations with the new owner. The lot is unable to be subdivided due to setback requirements by the town and does abut Rattlesnake conservation property. Chair Brian asked if there was a focus from the Open Space and Recreation Plan. Rebecca explained the process did not pin point one particular property but rather specific areas related to natural resources and connectivity between conservation properties or popular town areas. Chair Brian votes to deny acquisition interest of 23 Harris Farm Rd. Jeff B seconds, all unanimously agree.
7:45pm Chair Brian opens the hearing for the CSX request for determination of applicability. The commission asked if there have been any changes to the vegetation management plan. There had not been aside from changing one product to a less impactful product. The area affected would be the rail line across a very small portion of the south west side of Bolton that abuts Clinton and Berlin. Chair Brian makes a motion to make a negative 5 determination. Jeff B seconds, all unanimously approve.
